Digital human rights in the context of total digitalization and the introduction of intelligent technologies

Abstract

The paper examines the essence of digital human rights in the context of total digitalization and the introduction of artificial intelligence technologies. Conceptual approaches to defining digital rights as a continuation of traditional human rights in the digital environment are analyzed. Particular attention is paid to the risks of algorithmic discrimination, the transparency of automated decision-making, and personal data protection. The specific features of the implementation of digital rights in Ukraine under martial law are considered. Directions for improving the legal and institutional framework for the protection of digital human rights are proposed

Досліджено сутність цифрових прав людини в умовах тотальної цифровізації та впровадження технологій штучного інтелекту. Проаналізовано концептуальні підходи до визначення цифрових прав як продовження традиційних прав людини в цифровому середовищі. Окрему увагу приділено ризикам алгоритмічної дискримінації, проблемам прозорості автоматизованого прийняття рішень та захисту персональних даних. Розглянуто особливості реалізації цифрових прав в Україні в умовах воєнного стану. Запропоновано напрями вдосконалення правового та інституційного забезпечення захисту цифрових прав людини.
